TERMS OF SERVICE OF THE SKILLSTOMORROW PLATFORM

Effective from: June 1, 2026

§1. GENERAL PROVISIONS

1. These Terms of Service govern the use of the SkillsTomorrow online platform available at www.skillstomorrow.com (hereinafter: "Platform").

2. The operator of the Platform is SkillsTomorrow - an educational project available at www.skillstomorrow.com. Contact: kontakt@skillstomorrow.com.

3. The Platform serves as an intermediary connecting Users with Mentors, Speakers and educational institutions. The Operator is not a party to contracts concluded between Users and Mentors or Speakers.

4. Use of the Platform constitutes acceptance of these Terms of Service in their entirety.

5. The Terms of Service are available free of charge at www.skillstomorrow.com/regulamin.

§2. DEFINITIONS

Platform – the SkillsTomorrow online service available at www.skillstomorrow.com.

User – a natural person, institution or school using the Platform.

Mentor – an expert or practitioner registered on the Platform, whose profile can be discovered by Users and who can be invited by schools and institutions.

Speaker – an expert or presenter available for invitation by schools and institutions.

Session – an online or in-person meeting between a User and a Mentor or Speaker, organized through the Platform.

Account – the User's individual account on the Platform.

§3. SCOPE OF SERVICES

1. The Platform enables:

a) searching for and contacting Mentors from various industries and backgrounds,

b) inviting Speakers and experts to schools and educational institutions,

c) organizing educational experiences such as workshops, lectures and meetings,

2. The Operator provides a technical tool enabling contact and cooperation. The Operator does not provide mentoring or educational services directly - these services are provided by Mentors and Speakers as independent entities.

3. The terms of cooperation, including the financial terms of lectures and workshops, are determined directly between the User or School and the Mentor or Speaker. The Operator is not a party to these agreements and bears no responsibility for them.

4. The Operator reviews the profiles of Mentors and Speakers before they are made publicly available, however does not guarantee that the User will achieve specific results from using the Platform.

§4. REGISTRATION AND USER ACCOUNT

1. Using the full functionality of the Platform requires creating an account.

2. Registration is free. The User provides their first name, last name and email address.

3. The User undertakes to provide true data and to update it in case of changes.

4. The User bears full responsibility for the security of their password and access to their account.

5. The Operator reserves the right to suspend or delete an account in the event of a breach of the Terms of Service.

§5. THE OPERATOR'S ROLE AS INTERMEDIARY

1. SkillsTomorrow acts solely as an intermediary platform. The Operator connects Users with Mentors and Speakers, but is not a party to the mentoring or educational relationship.

2. The Operator is not responsible for:

a) content conveyed by Mentors or Speakers during Sessions,

b) the results of mentoring or training,

c) the cancellation or non-attendance of a Mentor or Speaker at a scheduled Session,

d) decisions made by the User based on information obtained from the Mentor,

e) financial settlements between the User and the Mentor or Speaker.

3. The Operator oversees the quality of the Platform and verifies Mentor and Speaker profiles to the extent of its capabilities, however does not guarantee uninterrupted availability of services.

4. In the event of problems with the delivery of a Session, including inappropriate behavior, breach of ethics or lack of professionalism on the part of the Mentor or Speaker, the User is obliged to immediately report the incident to: kontakt@skillstomorrow.com.

5. The Operator undertakes to review each report within 7 business days and take appropriate action, including suspending or removing the Mentor from the Platform.

§6. MENTORS AND SPEAKERS

1. Mentors and Speakers operate on the Platform as independent entities and bear full responsibility for the content and services they provide.

2. Before a profile is made publicly available on the Platform, the Operator reviews the Mentor's or Speaker's application and profile.

3. The Mentor and Speaker undertake to:

a) faithfully present their competences and experience,

b) maintain confidentiality of information obtained from the User,

c) comply with the principles of ethics and professionalism,

d) be punctual and reliable in delivering scheduled Sessions,

e) independently determine the financial terms of cooperation with the User or School.

4. The Operator reserves the right to remove a Mentor or Speaker from the Platform in the event of a breach of the Terms of Service or receipt of justified complaints from Users.

§7. SCHOOLS AND INSTITUTIONS

1. Schools and institutions may use the Platform to invite Speakers and experts to workshops, lectures and other educational events.

2. The Operator provides schools with contact details of Speakers and experts and tools for organizing cooperation. Detailed terms of cooperation and remuneration are determined directly between the school and the Speaker.

3. The Operator bears no responsibility for the course of events organized by schools with the participation of Speakers obtained through the Platform, nor for financial settlements between the parties.

4. In the event of problems with the cooperation, schools and institutions are obliged to immediately report the incident to: kontakt@skillstomorrow.com.

§8. PAYMENTS

1. Use of the Platform is currently free of charge.

2. The financial terms of cooperation between the User or School and the Mentor or Speaker are determined directly between the parties. The Operator is not a party to these transactions and does not charge a commission.

3. Before paid services are launched on the Platform, the applicable payment terms will be specified and made available to Users.

§9. COMPLAINTS AND REPORTS

1. All complaints, comments and reports regarding the functioning of the Platform or the behavior of Mentors and Speakers should be sent to: kontakt@skillstomorrow.com.

2. A report should include: the User's first and last name, a description of the problem, the date of the incident and any documents or evidence supporting the report.

3. The Operator processes complaints within 14 business days of receipt.

4. In the case of problems requiring an immediate response - in particular situations involving a safety threat or breach of ethics - please report immediately with the note: URGENT.

§10. PERSONAL DATA PROTECTION

1. Information concerning responsibility for the processing of Users' personal data, including the identification of the responsible entity, is set out in the Privacy Policy.

2. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Polish personal data protection act.

3. Detailed information regarding the processing of personal data is contained in the Privacy Policy available at www.skillstomorrow.com/polityka-prywatnosci.

4. The User has the right to access their data, rectify it, erase it, restrict processing and port the data.

§11. INTELLECTUAL PROPERTY

1. All content posted on the Platform by the Operator - including logos, graphics and texts - is protected by copyright and is the property of the Operator or cooperating entities.

2. The User is not authorized to copy, distribute or modify the Platform's content without prior written consent from the Operator.

3. Content created by Users (e.g. reviews, ratings) remains the property of the User, however the User grants the Operator a free license to display it on the Platform.

§12. OPERATOR'S LIABILITY

1. The Operator is not liable for:

a) interruptions in the Platform's operation caused by external factors or technical work,

b) content published by Mentors, Speakers and Users,

c) consequences of decisions made by the User based on information obtained through the Platform,

d) damages resulting from unauthorized access to the User's account caused by failure to properly protect login data,

e) the outcome of financial settlements between the User and the Mentor or Speaker.

§13. CHANGES TO THE TERMS OF SERVICE

1. The Operator reserves the right to change the Terms of Service at any time.

2. Users will be informed of changes to the Terms of Service by email and via a notice on the Platform with at least 14 days' notice.

3. Continued use of the Platform after the changes take effect constitutes acceptance of them.

§14. FINAL PROVISIONS

1. Matters not governed by these Terms of Service are subject to the provisions of Polish law, in particular the Civil Code and the act on the provision of services by electronic means.

2. Any disputes shall be resolved by the competent common court. Consumers have the right to use out-of-court methods of dispute resolution provided for under applicable law.

3. The Terms of Service enter into force on June 1, 2026.
